The prenuptial agreement -- not a romantic move, but it is smart

Asking someone for his or her hand in marriage is an exciting thing. Asking him or her to sign a marital contract, on the other hand, is far from exciting or romantic. However, getting a prenuptial agreement is a smart move. It is okay for individuals in New York or elsewhere to want to protect their assets in the event of divorce. No one knows what the future holds.

There are many people who believe that seeking a prenuptial agreement takes away from the joy of getting married. Who wants to plan for divorce at the same time they are planning a wedding? No one.

The simple truth is, despite even the best of intentions, numerous marriages -- approximately 50 percent -- end in divorce. The divorce rate among those married for the second or third time is even higher. A prenuptial agreement can help ensure that both parties, in the event of divorce, are taken care of and that any personal assets are appropriately protected.

A prenuptial agreement can be highly detailed or simply give a basic outline for what one wants in the event of divorce. It can include information about how assets are to be divided, what assets are deemed separate property, define inheritance issues and address a host of other issues.
