What is the process of filing an uncontested divorce in New York?

Whether you live in New York or elsewhere, there are several different ways to file for divorce. As every couple is different, having a variety of options can prove helpful in resolving each specific situation. An uncontested divorce is just one of the many ways couples can choose to dissolve their marriage.

An uncontested divorce is filed when either the couple is able to negotiate all the terms of their divorce settlement or when a request for divorce is not responded to. Some couples may be able to negotiate settlement terms privately or with the help of legal counsel or mediation services. In these cases, there is typically no need to go to court in order to finalize the divorce decree.

In cases where a spouse refuses to respond to the request for divorce, certain forms must be completed to finalize the divorce process. Some of these forms include a certification which authenticates the need for divorce, a summons to inform the other spouse of the filing and a verified complaint giving the reasons for the requested divorce. These forms, along with several others, must be submitted to complete this type of uncontested divorce.

Every form of divorce has its complexities, even uncontested divorce cases. Couples in New York who choose to file an uncontested divorce may still benefit from seeking assistance to ensure every aspect of their marital dissolution has been given proper attention. Negotiating terms can be a difficult process that will take some time, but doing so would spare couples the need for costly litigation and leave both parties with a settlement they are equally satisfied with.
