In New York, felony DWI charges apply to anyone who has already been convicted of a DWI in the last 10 years. If you have one previous conviction, the charge will be a Class E felony punishable by up to four years in prison. If you have been convicted of DWI more than once in the last 10 years (making this a third offense or greater), you will be charged with a Class D felony punishable by up to 7 years in prison.
