There are two situations in which prosecutors may charge you with an aggravated DWI under New York law.
The first is when the state alleges that at the time you were stopped, your blood-alcohol content (BAC) level was at .18 percent or greater. This is more than twice the legal limit of .08 BAC for a regular DWI. As bad as that sounds and even though the penalties are more severe than those for a regular DWI, aggravated DWI is still only a misdemeanor offense.
The second type of aggravated DWI charge is more serious and may be charged against anyone who drives with a BAC of .08 or greater and had a child under the age of sixteen in the car. In New York, this is a Class E felony punishable by up to four years in jail.
