2009 - Reversal of a client's Integrated Domestic Violence Court conviction of Harassment in the 2nd Degree

This case involved a trial in which a wife accused her husband of Harassment in the Second Degree. At trial, the husband sought to introduce evidence that his wife had previously threatened to "get" him. The Court forbid the admission of such evidence and convicted the husband. Dana Loiacono and Kathleen Wells appealed the trial court's exclusion of this important evidence. The appellate Court agreed with Ms. Wells and Ms. Loiacono and reversed the husband's harassment conviction ruling that the trial Court erred by excluding evidence that went directly to the wife's credibility
