Firm Defends Mother - Child Support Continued

Prior results do not guarantee a similar outcome.

The firm was successful defending a mother against the Father's petition to terminate child support based on his argument that the parties' daughter was emancipated. Parties appeared before the Support Magistrate and after a hearing, the Court ruled in favor of the mother and found that the child was not self-supporting. Subsequently, the father filed Objections to an Order of the Support Magistrate and the Family Court affirmed the decision and order, finding that the Father failed to prove that his daughter was sufficiently able to be self-supporting in order to deem her emancipated. The Orange County Family Court determined that the Support Magistrate did not abuse her discretion in dismissing the Father's application to terminate his child support obligation.
