March, 2011 – Larkin Ingrassia, PLLC successfully overturned a Supreme Court Decision and Order which denied a motion to dismiss a divorce action based on lack of adequate grounds for divorce. The Newburgh, NY law firm represented a husband in a divorce action filed by his wife based on the grounds of cruel and inhuman treatment. After successfully arguing that the plaintiff/wife failed to assert sufficient grounds to warrant a divorce in this long term marriage, the Supreme Court held that the action could be maintained for legal separation. Upon appeal to the Appellate Division, Second Department, the Supreme Court was reversed and the action was dismissed in its entirety.
